1. Agreement to Terms

By downloading, installing, or using KioskPilot ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. These Terms constitute a legally binding agreement between you ("User" or "you") and the operator of KioskPilot ("we," "us," or "our").

2. Description of Service

KioskPilot is an Android application designed for digital signage and trade show kiosk displays. The App provides:

• Display of images and videos from USB storage
• Configurable slideshow and display settings
• Kiosk mode functionality for unattended operation
• Layout customization options

The App is available in two versions: a free version with watermark and a Pro version (one-time purchase) without watermark.

3. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the App on Android devices you own or control
• Use the App for personal or commercial purposes as intended
• Access and use the features and functionality of the App

This license does not grant you any right to: (a) modify, reverse engineer, decompile, or disassemble the App; (b) remove, alter, or obscure any proprietary notices; (c) use the App in violation of applicable laws; or (d) sublicense, sell, or redistribute the App.

5. User Obligations

When using KioskPilot, you agree to:

• Comply with all applicable laws and regulations
• Use the App only for lawful purposes
• Not display content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable
• Ensure you have the necessary rights and licenses for all media content displayed through the App
• Not use the App to infringe on intellectual property rights of third parties
• Not attempt to interfere with, compromise, or disrupt the App's functionality

6. Intellectual Property Rights

All intellectual property rights in and to the App, including but not limited to software, design, graphics, text, and documentation, are owned by or licensed to us. These Terms do not transfer any ownership rights to you. The KioskPilot name, logo, and branding are trademarks or registered trademarks and may not be used without prior written permission.

7. User Content

You retain all rights to the images, videos, and other media content you display through the App ("User Content"). We do not claim ownership of your User Content. You are solely responsible for your User Content and warrant that you have all necessary rights to use and display such content. We do not monitor, store, or transmit your User Content, as all content remains on your local device.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

To the fullest extent permitted by law, we disclaim all warranties, including but not limited to:

• Warranties of merchantability, fitness for a particular purpose, and non-infringement
• Warranties that the App will be uninterrupted, error-free, or secure
• Warranties regarding the accuracy, reliability, or completeness of the App's features

We do not warrant that the App will meet your requirements or that defects will be corrected. Your use of the App is at your own risk.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our total liability for any claims arising out of or relating to these Terms or the App shall not exceed the amount you paid for the Pro version (if applicable) or €10, whichever is greater.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such jurisdictions, the above limitations may not apply to you.

10. Indemnification

You agree to indemnify, defend, and hold harmless KioskPilot, its operators, and affiliates from any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or related to: (a) your use or misuse of the App; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any rights of third parties, including intellectual property rights.

11. Updates and Modifications

We may, from time to time, update, modify, or discontinue the App or any features thereof. We may also update these Terms. Continued use of the App after such changes constitutes acceptance of the revised Terms. We are not obligated to provide updates or support, but we may do so at our discretion.

12. Termination

These Terms remain in effect until terminated. We may terminate or suspend your access to the App at any time, with or without cause or notice. You may terminate these Terms by uninstalling the App and ceasing all use. Upon termination, your license to use the App immediately ceases. Provisions that by their nature should survive termination (including disclaimers, limitations of liability, and indemnification) shall survive.

13. Third-Party Services

The App is distributed through Google Play Store and uses Google Play's in-app billing for Pro version purchases. Your use of Google Play is subject to Google's Terms of Service and Privacy Policy. We are not responsible for any third-party services or their terms.

14. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Germany, without regard to its conflict of law provisions. Any disputes arising from these Terms or the App shall be subject to the exclusive jurisdiction of the courts in Germany. If you are a consumer residing in the European Union, you may also have the right to bring proceedings in the courts of your country of residence.

15. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App and supersede all prior agreements and understandings. No waiver of any term shall be deemed a further or continuing waiver of such term or any other term.
